These Terms of Service ("Terms") govern your use of the website and services. By accessing or using our services, you acknowledge that you have read, understood, and agreed to be bound by these Terms. These Terms constitute an agreement between you ("Customer" or "You") and INNO Studio ("Company" or "We"). If you do not agree with any part of these Terms, please do not use our website or services.


Definitions


"Company": Refers to INNO Studio S.A.S., the entity providing the products and services outlined in these Terms.

"Customer": Any individual or legal entity that places an order on the Playtileswebsite.

"Product": Any physical or digital products or any service provided by the Company.

"Order": The act of purchasing products through the Playtiles website. This process involves the Customer reviewing the order details, agreeing to these Terms, and finalizing the purchase.

"Website": The online platform operated by the Company. The Website serves as the primary interface for customers to browse, purchase, and learn about Playtiles products.

Purpose


These Terms define the rights and obligations of both the Customer and the Company in the context of online sales of Playtiles-related products. They are designed to comply with relevant French and European regulations, including but not limited to:


- Consumer protection laws, such as the French Consumer Code.

- E-commerce directives, including the EU Directive on Electronic Commerce.

- Data protection regulations, such as the General Data Protection Regulation(GDPR).


The purpose of these Terms is to establish a clear and fair framework for the sale and purchase of Playtiles products, ensuring that both parties understand their respective responsibilities and rights.


Products


Products are presented on the website in English and/or French. The availability of products is subject to stock levels, and we reserve the right to update product offerings without prior notice. In case of unavailability, customers will be informed and offered alternatives, such as a similar product, a voucher, or the option to cancel their order.


We strive to provide accurate and up-to-date product information. However, due to the nature of the internet, there may be discrepancies in product appearance or specifications. We are not liable for any errors or omissions in product descriptions or images.


Due to the small-scale, artisanal nature of our production, certain parts of the product may be manufactured using 3D printing. Minor variations in finish, texture, or color between units are inherent to this process. By placing an order, the Customer acknowledges and accepts these characteristics as part of the product's nature and not as defects.


Prices


Prices are displayed in Euros (€) and include Value Added Tax (VAT). Shipping costs are additional unless otherwise specified during the checkout process. We reserve the right to modify prices at any time; however, such modifications will not affect orders that have already been placed.


In the event of a typographical error resulting in an incorrect price, we reserve the right to cancel the order and refund any amounts paid. We are committed to fair and transparent pricing, and any price adjustments will be communicated to affected customers promptly.


Order & Payment


The ordering process is secured and complies with relevant regulations. An order is confirmed through a "double-click" process, which constitutes acceptance of these Terms. This process involves the Customer reviewing the order details, agreeing to these Terms, and finalizing the purchase. Payment must be made in full at the time of order confirmation. We accept various payment methods, which are detailed during the checkout process.


For payments made by credit card, we ensure that transactions are secured using encryption technology to protect your personal and financial information. We adhere to industry standards for payment processing and data security.


We also reserve the right to request additional information or verification from the Customer to prevent fraudulent transactions. This may include proof of identity, address, or other relevant documentation.


Delivery


Delivery times are indicative and subject to the conditions guaranteed by our shipping partners. We strive to provide accurate and reliable delivery estimates; however, actual delivery times may vary due to factors beyond our control. In case of delay, customers will be informed. We are not responsible for delays caused by force majeure events, such as strikes, natural disasters, or other unforeseeable circumstances.


We offer various shipping options, which are detailed during the checkout process.

Customers are responsible for selecting the appropriate shipping method and providing accurate delivery information. We are not liable for any delays or issues resulting from incorrect or incomplete delivery information provided by the Customer.


International Returns & Customs Fees


For any authorized return from outside the European Union, you are responsible for ensuring the shipment is correctly declared as "RETURNED GOODS" with a nominal value on all customs forms. If the shipment arrives incurring any import duties, taxes, or handling fees for the Company, we reserve the right to refuse the shipment or deduct the full amount of such fees from any refund.


Right of Withdrawal


For Customers with a delivery address within the European Union:

In accordance with EU consumer protection law, you have the right to withdraw from your order within 14 days of receiving the goods without giving any reason. You may open and handle the controller only as you would be allowed to in a shop, to establish its nature, characteristics and functioning, and you keep your right to withdraw even if you have done so. Inspecting the controller in this way does not include peeling it from its backing card or applying its micro-suction face to a device: that goes beyond what is necessary to establish its functioning and may reduce your refund as set out below. You remain liable for any diminished value of the goods resulting from handling beyond what is necessary for that purpose.


Return shipping is your responsibility: you arrange and pay for your own return, and the cost of returning the goods to us is not reimbursed. We will reimburse the price you paid within 14 days of the day we are informed of your decision to withdraw, using the same means of payment you used, with no additional fee charged by us. We may withhold the reimbursement until we have received the goods back, or until you have supplied evidence of having sent them back, whichever is the earliest. Your reimbursement includes the standard outbound delivery cost you paid (we need not reimburse any supplement for a delivery method costlier than our least expensive standard option), but not the cost of returning the goods to us.


How to withdraw: You may use our online withdrawal function, complete a model withdrawal form, or send us any unambiguous statement of your decision. We will acknowledge receipt without delay by email.


For Customers with a delivery address outside the European Union:

All sales are final. We do not accept returns or offer refunds for change of mind. We only accept returns for items that are defective or materially not as described. In such cases, you must contact us within 7 days of delivery. Any return must be pre-authorized by us and shipped according to our instructions. Return shipping costs for authorized defective returns are your responsibility.


The right of withdrawal does not apply to goods made to your specifications or clearly personalised. The controller has a micro-suction face. Once it has been applied to a device it is no longer new and requires reconditioning before resale: a replacement backing card, cleaning of the micro-suction, and manual inspection and restoration. Where this has occurred we may deduct from your refund an amount reflecting that reconditioning cost, up to the value of the controller (€5 within a bundle; see apportionment below). Merely removing the controller from its packaging to inspect it, without applying it to a device, is not a basis for any deduction.


Digital Content: The Playtiles games and Season Passes are digital content supplied other than on a tangible medium, in the form of a unique, single-use redeem code, sold at €30 on their own and bundled with a controller at €35. At checkout you expressly request that we make this redeem code available to you before the end of your 14-day withdrawal period and acknowledge that you thereby lose your right of withdrawal in respect of it. Once the code is redeemed, which we record with a timestamp, performance is complete and your right of withdrawal for that digital content is lost. We confirm this consent and acknowledgement to you on a durable medium (by email).


Apportionment: In a bundle, the controller corresponds to €5 and the Season Pass to €30, matching our standalone prices. If you withdraw from the controller after the Season Pass code has been redeemed, we refund the controller portion only (subject to any diminished-value deduction above), plus standard outbound delivery. The Season Pass portion is retained.


Liability


The Company is responsible for the proper execution of obligations resulting from the contract, except in cases of force majeure. The choice and purchase of products are the customer's responsibility. The Company is not liable for any indirect damages, such as loss of profit or opportunity, resulting from the use of its products.


We are not liable for any damages arising from the misuse or improper use of its products. Customers are responsible for using the products in accordance with the instructions and guidelines provided by the Company.


Intellectual Property


All intellectual property rights related to the products, including trademarks, copyrights, and patents, remain the property of the Company. Customers are prohibited from reproducing, selling, distributing, or modifying Playtiles products without explicit permission.


Dispute Resolution


In case of a dispute, the Customer and the Company agree to seek an amicable resolution through mediation or arbitration before proceeding to litigation. The venue for any legal proceedings will be the competent courts in the jurisdiction where the Company is headquartered.


Force Majeure


The Company is not liable for any delays or failures in performance resulting from force majeure events, including but not limited to natural disasters, wars, civil unrest, and government actions. In such cases, we will notify the Customer and make reasonable efforts to mitigate the impact of the force majeure event.


Limitation of Liability


Our total liability for any claims arising from these Terms or the use of its products is limited to the amount paid by the Customer for the products. The Company is not liable for any consequential or indirect damages, such as loss of profits or business interruption.


Confidentiality


Both parties agree to maintain the confidentiality of any non-public, sensitive information disclosed during the course of their interactions. This obligation does not apply to information that is already in the public domain or required to be disclosed by law.


Amendments


We reserve the right to amend these Terms at any time to reflect changes in our services, business practices, or legal obligations. The most current version will always be posted on our Website. For existing customers, material changes that negatively affect your rights will not apply retroactively to orders already placed. Your continued use of our services after such changes constitutes your acceptance of the new Terms.


Governing Language


These Terms are provided in English and/or French and may be translated into other languages for convenience. In case of discrepancies, the French version will prevail.


Third-Party Links & Services

The Playtiles website may contain links to third-party sites. We are not responsible for the content or actions of these sites and provide these links for informational purposes only.


Compliance With Laws


Customers are responsible for complying with all applicable laws and regulations in their jurisdiction when using Playtiles products. We reserve the right to terminate services if a customer's use violates any laws or these Terms.


Customer Support


We provide customer support services to assist with inquiries and issues related to its products. Customers can contact support through the provided email or phone number. We strive to respond to customer inquiries promptly and effectively.


Data Protection


Customer data is collected for order processing and may be shared with contractual partners, such as accounting and legal firms. Customers can exercise their rights to access, rectify, and oppose the use of their data by contacting the Company.


We are committed to protecting customer data and adheres to relevant data protection regulations, including the General Data Protection Regulation (GDPR). We implement appropriate technical and organizational measures to ensure the security and confidentiality of customer data.
